Services K.W Roofing & Exteriors provides roofing, re-roofing, roof repairs, exterior siding, gutter and related exterior services (collectively, “Services”). Services will be provided only pursuant to a written contract or proposal that sets forth the scope of work, total price, payment schedule, completion schedule, and any warranties.
Estimates, contracts and payments
• All estimates are valid for [30/60/90] days unless otherwise stated.
• A written contract signed by both parties is required for work exceeding the amount set by California law for home solicitation waivers (or other statutory thresholds). Do not rely on verbal commitments for significant projects.
• Payment terms, deposits, milestone payments, and final payment will be specified in the written contract. K.W Roofing & Exteriors may require a deposit. Final payment is due upon substantial completion, subject to contract terms.
• Failure to pay as agreed may result in late fees, suspension of work, recovery of costs, and/or filing of mechanic’s lien(s) or other legal remedies permitted by California law.
Permits, inspections and site access
• Unless stated otherwise in the contract, the customer is responsible for obtaining required permits and scheduling required inspections. If K.W Roofing & Exteriors agrees to obtain permits, permit fees are in addition to the contract price unless included.
• The customer must provide reasonable access to the property, utilities, and a safe working environment. K.W Roofing & Exteriors is not responsible for delays caused by lack of access or unsafe conditions.
Warranties and disclaimers
• Manufacturer warranties on materials may apply; K.W Roofing & Exteriors will pass through such warranties to the extent permitted and described in the written contract.
• Any express warranty provided by K.W Roofing & Exteriors will be stated in the contract. Except as expressly provided in a written warranty, Services are provided “as is” and K.W Roofing & Exteriors expressly disclaims all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose to the fullest extent permitted by law.
• Some statutory consumer protections cannot be waived; this disclaimer is subject to applicable California consumer protection law.
Changes, extras and unforeseen conditions
• Unforeseen conditions (e.g., hidden damage, structural issues, unauthorized prior work) discovered after work begins may require additional labor/materials. Such changes will be documented in change orders and priced separately. Work will not proceed on change orders until authorized per the contract.
Cancellation and refunds
• The customer’s right to cancel and any applicable cancellation fees will be described in the written contract. For home solicitation contracts, California law provides specific cancellation rights — consult the contract and a qualified attorney if you have questions.

K.W Roofing & Exteriors is not liable for indirect, incidental, consequential, punitive, or special damages.
• Some jurisdictions do not allow limitation of certain damages; if such limitations are unenforceable, K.W Roofing & Exteriors’ liability will be limited to the maximum extent allowed by law.
Indemnity
• To the extent permitted by law, the customer agrees to indemnify and hold harmless K.W Roofing & Exteriors, its affiliates, officers, employees, and agents from liabilities, claims, losses, and expenses (including reasonable attorneys’ fees) arising out of customer’s negligence, breach of contract, or willful misconduct.

If payment is not timely, K.W Roofing & Exteriors may exercise legal remedies, including recording a lien, withholding final documents, or pursuing collection and litigation. These remedies will be used only as permitted by California law and the contract.
